Attorney General Merrick Garland announced Friday that David Weiss of Delaware, who has been looking into charges brought against President Biden’s surviving son, Hunter Biden, has been appointed a special counsel. On Tuesday of this week, Weiss approached Garland with a request to serve as his special counsel.

Background President Biden’s, Son

President Biden’s, Hunter Biden has been the subject of an investigation since 2019 thanks to Weiss, a Trump-appointed U.S. attorney who was hired during the Biden administration. He and Hunter Biden came to a tentative plea agreement, but it fell apart under the scrutiny of a federal judge in Delaware.

Weiss is permitted in the order appointing him to be special counsel to “conduct the ongoing investigation described above, as well as any matters that arose from that investigation or may arise.”
By the ruling, Weiss is permitted to “prosecute federal crimes in any federal judicial district arising from the investigation of these matters.”

Weiss requested the status of special counsel earlier this week, according to Attorney General Garland, after deciding that “in his judgment, his investigation has reached a stage at which he should continue his work as Special Counsel and he asked to be so appointed.”

 The Special Counsel

David Weiss has worked for the Justice Department for 20 years. Since 2018, he has held the position of United States Attorney for the District of Delaware. Weiss is a reputable prosecutor with a solid track record for objectivity and fairness. He is renowned for his knowledge of financial crimes as well.

Weiss is a Yale Law School alum. Before working for the Justice Department, he served as a clerk for Judge Guido Calabresi of the U.S. Court of Appeals for the Second Circuit. Weiss has held a variety of posts within the Justice Department, including that of chief of the Public Integrity Section in the Criminal Division and assistant US attorney in the District of Columbia.

Weiss is a very qualified candidate to act as the special prosecutor in the Hunter Biden inquiry. He is qualified to perform a fair and unbiased investigation due to his experience, knowledge, and reputation.

The Investigation

After his inquiry, Weiss will submit a report by special counsel regulations. In accordance with the law and Justice Department protocol, Garland declared he would make that report public.

Recently, the judge in the Hunter Biden case said she wasn’t ready to accept the plea agreement between the president’s son and the Justice Department. She urged both sides to submit further documents and return to court later.

She insisted that the attorneys on both parties make it abundantly clear that the agreement does not grant Biden a broad immunity from prosecution for his commercial operations. Hunter Biden thus entered a not-guilty plea to two misdemeanor charges involving his federal income tax filing. If Noreika approves a new plea deal, he will withdraw that admission.

The Implications

  • According to a court document, the prosecutor in the case stated on Friday that a trial is necessary because the parties have reached an impasse regarding the plea agreement.
  • According to the Justice Department’s filing, “Following additional negotiations after the hearing held on July 26, 2023, the parties are at an impasse and are not in agreement on either a plea agreement or a diversion agreement.”
  • According to the report, prosecutors asked for Biden’s testimony on August 9 and need it by August 11. According to Biden’s solicitors, they requested a delay until August 14 “which the Government declined.” The filing stated that Biden had not yet stated his view.
  • The motion stated, “There is no longer a plea agreement or diversion agreement for the Court to consider. Accordingly, the Government respectfully requests that the Court vacate its briefing order.”
  • President Biden’s, Hunter Biden consented to plead guilty to two misdemeanor offenses relating to his federal income tax filing earlier this year. He was also accused by federal officials of committing a felony firearm offense, but he consented to a pretrial diversion deal that shields him from prosecution.
  • President Biden’s, son Hunter Biden did not pay federal income taxes for either 2017 or 2018, despite owing more than $100,000 in taxes each year, claims David Weiss, the Trump-appointed Delaware U.S. attorney.
  • Additionally, Weiss’ office said that Biden had a handgun in October 2018 despite being aware of his illegal drug usage and addiction.
  • President Biden’s, son Hunter Biden faced possible punishments of 10 years in prison for the handgun charge and 12 months in jail for each tax offense; however, Weiss’ office emphasized that real sentences handed down by courts are frequently less than the maximums. The Justice Department agreed to recommend probation on the tax charges, according to a source familiar with the agreement, but a court will ultimately decide.
  • Republicans have claimed that the plea agreement reached for President Biden s, son Hunter Biden was an instance of unfair treatment soon after former President Donald Trump was charged with handling secret documents in connection with separate and unrelated federal charges. Trump was accused separately for his involvement in the Capitol disturbance on January 6.
  • “If this special counsel is truly independent,” a Trump spokesperson
  • He said in a statement, “he will quickly conclude that Joe Biden, his troubled son Hunter, and their enablers, including the media, which colluded with the 51 intelligence officials who knowingly misled the public about Hunter’s laptop, should face consequences even though he failed to bring proper charges after a four-year investigation and appears to be trying to move the case to a more Democrat-friendly venue.”
